Terms of Service

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of the TentPilot platform, including our website, web application, APIs, and related services (collectively, the "Service"), operated by TentPilot ("we," "us," or "our").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

TentPilot is a cloud-based IoT monitoring platform that provides:

• Sensor data collection — connecting to your IoT devices (temperature sensors, humidity sensors, controllers, and similar hardware) via their manufacturer APIs to collect environmental readings.
• Dashboards and visualization — real-time and historical display of sensor data through web-based dashboards.
• Threshold alerting — user-configured alerts when sensor readings cross defined thresholds, delivered via email, SMS, WhatsApp, Telegram, or other supported channels.
• AI-powered advisory analysis — periodic trend analysis of your sensor data using large language models (LLMs) to provide actionable observations and recommendations.
• Adapter engine — AI-assisted generation of device integration configurations ("adapters") that enable the platform to communicate with your specific hardware.
• Automated control (where available) — deterministic setpoint management for compatible controller devices, with LLM-based monitoring and anomaly detection.

The Service connects to third-party device APIs using credentials you provide. We act as an intermediary between you and your device ecosystems; we do not manufacture, sell, or control any IoT hardware.

3. Account Terms

3.1 Account Creation

To use the Service, you must create an account by providing accurate and complete information, including a valid email address. You must be at least 18 years old to create an account.

3.2 One Account Per Person

Each individual may maintain only one account. Creating multiple accounts to circumvent plan limits, abuse free-tier resources, or evade enforcement actions is prohibited.

3.3 Account Security

You are responsible for maintaining the security of your account credentials. You must choose a strong, unique password, not share your account credentials with others, and notify us immediately if you suspect unauthorized access to your account.

We are not liable for any loss or damage arising from your failure to secure your account.

3.4 Accurate Information

You agree to provide truthful, accurate, and current information during registration and to update it as necessary. We reserve the right to suspend or terminate accounts that contain materially false or outdated information.

4. Subscription Plans and Billing

4.1 Plans

Plan features, limits, and pricing are subject to change. We will provide at least 30 days' notice before any pricing changes take effect for existing subscribers.

4.2 Free Tier

The Free tier is provided at no cost and is subject to additional usage limits, including but not limited to: a 15-minute minimum polling interval, email-only notifications, a maximum of 10 alert emails per week, and automatic pausing of inactive accounts after 14 days without login. The Free tier does not include AI advisory analysis.

4.3 Billing and Payment

Paid subscriptions are billed monthly through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on file on a recurring monthly basis. All fees are stated in U.S. dollars. We do not store your credit card information directly. All payment processing is handled by Stripe, Inc. in accordance with PCI DSS standards.

4.4 Auto-Renewal

Paid subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.

4.5 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the period you have already paid for.

4.6 Refunds

If you cancel a paid subscription within the first 14 days of your initial subscription (not a renewal), you may request a full refund. After the initial 14-day period, no partial refunds are issued for unused time.

5. Acceptable Use

You agree not to:

1. Use the Service for any illegal purpose or in violation of any applicable law or regulation.
2. Reverse engineer, decompile, or disassemble any part of the Service.
3. Scrape, crawl, or use automated means to extract data from the Service beyond documented APIs.
4. Attempt to gain unauthorized access to other users' accounts or infrastructure.
5. Interfere with or disrupt the Service, servers, or networks.
6. Circumvent plan limits by creating multiple accounts or manipulating configurations.
7. Use the Service to monitor environments where such monitoring is prohibited by law.
8. Resell or redistribute the Service without our written consent.
9. Submit false device credentials or credentials for devices you do not own.

6. Device Credentials and Third-Party APIs

6.1 Your Credentials

To connect your IoT devices, you provide API keys, tokens, or other credentials for third-party device ecosystems. You represent that you own or are authorized to use these credentials and have the right to grant us access to poll data from the associated devices.

6.2 How We Handle Credentials

Your device credentials are encrypted at rest using Fernet symmetric encryption, never stored in plaintext, never logged, never displayed after initial entry, and deleted immediately when you remove an adapter or delete your account.

6.3 Third-Party API Limitations

The Service depends on third-party device ecosystem APIs. We do not control these APIs and are not responsible for changes to their availability, rate limits, or terms of service.

7. Data Ownership and License

7.1 Your Data

You retain full ownership of your sensor data, device configurations, alert settings, and any other content you create through the Service.

7.2 License to Process

By using the Service, you grant us a limited, non-exclusive license to access, collect, store, process, and display your data solely for the purpose of providing and improving the Service. This license terminates when you delete your account.

7.3 Aggregated Data

We may create aggregated, anonymized data that does not identify you. We may use this data for any lawful purpose, including to improve the Service.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted or error-free operation. For Pro and Business subscribers, we target 99.5% monthly uptime for core functionality. This is a target, not a contractual guarantee.

9. Limitation of Liability

9.1 Advisory Nature

THE SERVICE PROVIDES MONITORING, DATA COLLECTION, AND AI-GENERATED ADVISORY INFORMATION. IT DOES NOT PROVIDE GUARANTEES REGARDING THE CONDITIONS OF YOUR MONITORED ENVIRONMENTS.

Alerts may be delayed, missed, or inaccurate. AI recommendations are informational and may contain errors. You remain solely responsible for monitoring and managing your environments, equipment, and crops.

9.2 Specific Exclusions

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TENTPILOT SHALL NOT BE LIABLE FOR:

1. Crop loss, plant damage, or reduced yields resulting from missed alerts or AI advisory errors.
2. Equipment damage or malfunction arising from automated control actions.
3. Spoilage of perishable goods due to missed temperature or humidity alerts.
4. Regulatory compliance failures arising from reliance on the Service.
5. Financial losses, including lost revenue or business interruption.
6. Damage to property resulting from missed or delayed alerts.

9.3 Maximum Liability

TENTPILOT'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

9.4 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

10. Indemnification

You agree to indemnify and hold harmless TentPilot from claims arising out of your use of the Service, violation of these Terms, or any claim by a third party related to environments you monitor.

11. Termination and Data Retention

You may terminate your account at any time. Upon termination, device credentials are deleted immediately. Account data is retained for 90 days to allow data export, then permanently deleted.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas. Any dispute shall be resolved by binding arbitration administered by the American Arbitration Association. You agree that any dispute will be resolved on an individual basis only. You waive your right to participate in a class action.

You may opt out of arbitration by sending written notice within 30 days of creating your account.
